M4YWeb (YoursPorto, Lda), headquartered at Rua dos Caldeireiros 135, 4050-140 Porto, Portugal (M4YWeb), is, among other activities, the owner of a permission marketing campaign service. This service is carried out through several websites belonging to the company. The permission marketing campaign service is provided to the user (Subscriber) under the terms and conditions of this agreement. This document represents the entire agreement between the Subscriber and M4YWeb.
The permission marketing campaign service consists of sending, with the user's explicit permission, emails and/or text messages containing information and advertising on products and services that fit the user's socio-demographic profile.
The Subscriber declares that he or she agrees to:
The Subscriber acknowledges that he or she is aware that such data (Registration Data) will be incorporated in an automated file or personal data processing system.
Should the Subscriber provide untrue or inaccurate information, M4YWeb reserves the right to cancel the Subscriber's subscription and terminate the Subscriber's right to use the Service.
The Subscriber authorizes M4YWeb to retain and use the Subscriber's data in order to offer him/her other services and products.
The Subscriber is aware that his/her Registration Data is collected, recorded and stored on M4YWeb servers.
The Subscriber may exercise his/her rights of access, rectification, cancellation and opposition with regard to the processing of his/her personal data. The Subscriber may also exercise his/her data portability and deletion rights.

The Subscriber explicitly agrees to solely assume any and all risks arising from the use of the permission marketing campaign service.
M4YWeb shall not be liable for any loss of use or business interruption, nor for any direct, indirect, special, incidental, or collateral damage arising from any kind of negligence (including loss of profit).
M4YWeb does not guarantee that the service will meet the Subscriber's requirements, that the use of service will be uninterrupted, safe, timely or error-free, or that the information obtained from the Service will be accurate or reliable. Likewise, M4YWeb does not guarantee that any service defects will be corrected.
M4YWeb websites and emails may contain links to other websites that are not controlled by M4YWeb.
If the user accesses other websites by using these links, he/she should be aware that such websites may request and collect personal data under their own privacy policies, which may differ from ours.
It is also important to point out that M4YWeb websites and emails may occasionally provide links to websites created and operated by other organizations.
Since these sites are not owned by M4YWeb, we cannot guarantee their quality, adequacy or performance. Our relationship with these websites does not presuppose an endorsement of the products, services or information offered therein.
M4YWeb strongly recommends caution when visiting these websites, bearing in mind that under no circumstances shall M4YWeb be directly or indirectly liable for any damage or loss caused (or allegedly caused) to the user or the user's family by the contents, goods or services available on those websites.
The Subscriber explicitly agrees to solely assume any and all risks arising from the use of the permission marketing campaign service. .
M4YWeb services are meant to be used by M4YWeb Subscribers and Customers (Sponsors) only. M4YWeb Subscribers and Sponsors agree not to share or use the Service for any commercial purposes without the express consent of M4YWeb.
The Subscriber is solely responsible for the content of the communications made through the Service. The use of the service by the Subscriber is subject to local, district, autonomic, national and international laws and regulations.
The Subscriber agrees:
If the Subscriber's conduct violates these terms and conditions, M4YWeb may terminate the permission marketing campaign service at its own discretion.
The Subscriber agrees to compensate and not to hold M4YWeb, its subsidiaries, affiliates, directors or employees liable for any third-party claim or legal proceeding, including reasonable attorneys' fees arising from improper use of the permission marketing campaign service or from any violation of the provisions set forth in this agreement by the Subscriber.
The Subscriber may communicate with the Sponsors that present their products by means of the permission marketing campaign service or even participate in their advertising campaigns. Such communication or participation in campaigns, including the delivery and payment of goods and services, as well as any terms, conditions and warranties pertaining to said communications, shall be established solely between the Subscriber and the Sponsor. M4YWeb assumes no responsibility or obligation whatsoever regarding such communication or participation.
This Agreement shall be governed by Portuguese Laws, and the parties agree to submit any dispute arising out of this agreement to the exclusive jurisdiction of the courts of Porto (Portugal).
Due to the special conditions of the Service, and in order to provide the most adequate service at all times, M4YWeb may change the terms and conditions of this Agreement by notifying the Subscriber of any such changes on our website, in such a way that the Subscriber will know about them. By using the permission marketing campaign service uninterruptedly, the Subscriber accepts this document with all the modifications and amendments contained herein.
For the above-mentioned reasons, M4YWeb reserves the right to modify or discontinue the Permission Marketing Campaign Service, in whole or in part, with or without prior notification to the Subscriber. M4YWeb shall not be held liable by the Subscriber or any third party for having exercised the right to modify or discontinue the permission marketing campaign service.
Both the Subscriber and M4YWeb may terminate the Service at any time, without prior notice, with or without justification, and such decision shall take immediate effect. M4YWeb shall not be held liable by the Subscriber or any third party for the termination of the permission marketing campaign service.
If the Subscriber does not agree with any of the terms and conditions in this Agreement or with any changes thereof, or if he/she is not satisfied with the permission marketing campaign service, he/she may:
Upon termination of the Service, the Subscriber's right to use the permission marketing campaign service shall cease immediately.
M4YWeb is aware of the implementation of the new General Data Protection Regulation - GDPR, REGULATION (EU) 2016/ 679 OF THE EUROPEAN PARLIAMENT AND OF THE COUNCIL of April 27, 2016, on the protection of natural persons with regard to the processing of personal data and on the free movement such data. M4YWeb is committed to acting in accordance with the regulation and is taking all appropriate steps in this direction.
